Family courts no longer private

Traditionally family courts have been private arenas.  The Family Procedure Rules have now been changed.  As of 27 January 2025, Journalists and bloggers will be able to attend and anonymously report on family cases if a transparency order is granted.  The presumption is that such orders will be made unless there is a legitimate reason not to do so.

By contrast, family mediation is confidential.  There are a few limited exceptions but otherwise, matters discussed in mediation, remain in mediation and can only be shared with the parties’ lawyers.  There is no fear of a journalist reporting on the issues raised in mediation.  Hence, parties can talk frankly about their hopes and fears.  This can clear up a lot of misunderstandings and bring about an early resolution.
